Terms & Conditions Blue Life Charters-In consideration with any charter reservation, Blue Life Charters LLC agrees to reserve the vessel “Llibertat” and to contract a USCG licensed captain and crew.
Fees and Rescheduling
Charter fees are deemed earned upon placing a hold for desired date and time. Charterer’s requests for rescheduling will be considered on a case-by-case basis.
Requests to reschedule within 24 hours or less from the start time of the sail are not accepted and Charterer is responsible for full payment, regardless of whether the scheduled sail occurs or not.
Cancellation & Rescheduling Policy
All cancellations by guests will be handled on a case by case situation. The more advanced notice of cancellation that is given, the more refund that can be provided. No refund will be given if you cancel within 48 hours of departure.
Charter fees are deemed earned upon placing a hold for desired date and time. Charterer’s requests for rescheduling will be considered on a case by case basis and are subject to a rescheduling fee and availability. The rescheduling fee is determined by the amount of notice given prior to the charter date and time and are as follows:
- 7 days or more prior to sail: free
- Within 7 days of sailing: $50
- 24 -72 hours prior to sail: $150

Cancellation by Captain
In the event of a cancellation by the captain of the vessel due to severe weather, environmental conditions, unforeseen prohibitive circumstances, or mechanical failure, the sail will be rescheduled to a mutually agreeable date prior to December 31st of the current year at no additional charge. Severe weather is determined solely by the captain of the vessel. If we cannot reschedule, a full refund will be given in the form of money or a gift card. We always show up to the boat regardless of the forecast that day; the weatherman is only correct 1% of the time. Just because it rains earlier in the day does not mean we will cancel your sail that afternoon or evening. If the captain determines the weather is unfit for a sail before you arrive, they may call you to reschedule or off you a refund.
Cancellation By Guest
IIn the event of cancellation by the charter guest once paid in full, there will be a 100% refund if cancelled more than 7 days prior to sail date, 50% refund given if within 7 days of sail date. There is no refund for cancellations within 48 hours of the scheduled charter. We are charged for each credit charge and refund, cancellations mean we lose out on other charter guests that we turned down because of your booking. However, you may reschedule your charter if you wish with applicable fees.
Substance Abuse
The use of illegal substances is strictly forbidden on board the vessel. This includes underage use of alcohol or cigarettes. Non-compliance of this rule will result in the termination of the sail and no refund will be given.
Risks
Charterer understands and accepts that there is an inherent risk of personal injury or accident, “Risks”, which may occur at marinas and onboard sailboats. Therefore, Charterer agrees to release and hold harmless Blue Life Charters LLC, its members, crew and agents from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties.
Charterer has discussed the Risks with their invitees, and all invitees have agreed to release and hold harmless Blue Life Charters LLC, its members, crew and agents in the same manner Charterer has in the above paragraphs. The foregoing notwithstanding, Charterer agrees to indemnify and hold harmless Blue Life Charters LLC, its owners, crew, and agents from any claims brought by Charterer’s invitees.
If it is necessary to obtain medical treatment for the Charterer or its invitees, regardless of cause, such expenses shall be paid by the Charterer. Authority is granted without limitation to Blue Life Charters LLC
Disputes shall be governed by Federal Maritime law. In any action against Blue Life Charters LLC, or its members, agents, partners, employees, or servants which results in a decision/judgment/decree/order/stipulation or settlement substantially upholding Blue Life Charters LLC, the adversary party shall reimburse Blue Life Charters LLC attorney’s fees, court costs, and expenses.
Photography Release
In Terms & Conditions of photographic release-From time to time photos of our guests are captured by our crew and given to the guests or posted on Facebook. I hereby grant Blue Life Charters LLC, the photographer onboard, and their legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for editorial trade, advertising, and any other purpose and in any manner and medium; and to alter the same without restriction. I hereby release Photographer and his or her legal representatives and assigns from all claims and liability relating to said photographs.
